Terms and Conditions of Sale

1. Who we are

tluxy.com (the "Website") is operated by Trade Lux Italia S.r.l., Via A. Manzoni 112/b, 80123 Naples (NA), Italy, VAT no. IT06700101212, e-mail customercare@tluxy.it, phone +39 081 7148338 ("T.LUXY", "we").

2. Scope

These terms govern distance sales made through the Website. For consumers, the Italian Consumer Code (Legislative Decree 206/2005) applies, together with any more favourable mandatory rules of the consumer's country of residence. The terms published at the time of the order apply.

3. Formation of the contract

Your order is an offer to purchase. We send you an e-mail acknowledging receipt of the order; the contract is concluded when we send the Dispatch Confirmation e-mail. Items not included in that confirmation are not part of the contract and, if already paid for, are refunded without undue delay. The contract may be concluded in English or Italian and is stored in our systems.

4. Products and availability

All products are 100% authentic. Their main characteristics are described on each product page; colours and details may vary slightly depending on your screen. If an ordered product is no longer available we inform you and refund you within 30 days. We may refuse orders whose quantity or pattern reasonably suggests they are intended for resale.

5. Prices

Prices are shown in the currency of your market. For Italy and the European Union they include VAT. For non-EU countries they exclude Italian VAT: import duties, taxes and customs charges of the destination country are not included and are payable by the customer, unless stated otherwise at checkout. Shipping costs are shown before you confirm the order. Whenever we announce a price reduction we also show the lowest price applied in the previous 30 days. If an obvious pricing error occurs we contact you before dispatch and you may confirm or cancel the order.

6. Payment

We accept credit and debit cards, PayPal, Shop Pay, Apple Pay, Google Pay, Scalapay and Klarna. Payment data is handled directly by the payment providers through secure protocols; we do not store full card details. With Scalapay you pay in instalments under Scalapay's own terms and the related receivables may be assigned as stated by Scalapay.

7. Shipping and delivery

Delivery times, costs and countries served are set out in our Shipping page and at checkout. Risk of loss or damage passes to the consumer on delivery. Non-EU shipments may be inspected by customs. Please check the parcel on delivery and, if it looks tampered with, sign with reservation or refuse it and contact us.

8. Right of withdrawal

Consumers may withdraw within 14 days of delivery without giving any reason. Full details, the return costs and the model withdrawal form are in our Return Policy page. 

9. Legal guarantee of conformity

All products are covered by the legal guarantee of conformity (arts. 128 ff. Italian Consumer Code): we are liable for any lack of conformity that becomes apparent within 2 years of delivery, and claims may be brought within 26 months of delivery. You are entitled to free repair or replacement and, where these are impossible or disproportionate, to a price reduction or termination of the contract. See our Legal guarantee page.

10. Authenticity and intellectual property

We guarantee the authenticity of every product sold on the Website. Trademarks, images, texts and other content belong to T.LUXY or to their respective owners and may not be reproduced without written permission.

11. Liability

We are not liable for failures caused by force majeure or by third parties. Nothing in these terms limits consumers' mandatory rights or our liability for wilful misconduct or gross negligence.

12. Complaints and dispute resolution

Send complaints to customercare@tluxy.it; we reply within 7 working days. Consumers may also turn to an alternative dispute resolution (ADR) body or to the European Consumer Centres Network (ECC-Net). The EU ODR platform was discontinued on 20 July 2025.

13. Governing law and jurisdiction

Italian law applies, without prejudice to more favourable mandatory rules of the consumer's country of residence. For consumers, the competent court is the court of the consumer's place of residence or domicile; for business customers, the Court of Naples.

14. Changes

We may update these terms; the version in force at the time of your order applies.

15. Privacy

Personal data is processed as described in our Privacy Policy, in accordance with Regulation (EU) 2016/679 (GDPR).
